INTRODUCTION
1.1 Background to the Study
Elections constitute one of the most important mechanisms through which democratic societies establish political legitimacy, determine political leadership and facilitate peaceful transfer of governmental authority. The credibility of elections is therefore fundamental to democratic stability because citizens are more likely to accept electoral outcomes when they perceive the electoral process as transparent, inclusive, accountable and free from manipulation. According to Norris (2014), electoral integrity concerns the extent to which elections conform to internationally recognized democratic standards and are conducted in accordance with established rules. Similarly, Birch (2011) argues that the quality and legitimacy of elections are influenced not only by voting procedures but also by the integrity of electoral administration, the transparency of result management and citizens’ confidence in the process.
Nigeria’s democratic experience has, however, been characterized by recurring concerns about electoral malpractice, manipulation of results, vote buying, violence, poor administration and weak public confidence. The history of electoral administration in Nigeria demonstrates that electoral credibility has remained a major concern since the return to democratic government in 1999. Jega and Hillier (2012) observe that weaknesses in electoral administration, inadequate institutional capacity and manipulation of electoral processes contributed significantly to the credibility problems associated with earlier Nigerian elections. These challenges stimulated successive electoral reforms aimed at strengthening the institutional and technological capacity of the Independent National Electoral Commission (INEC).
The introduction of technology into electoral administration has consequently become an important component of Nigeria’s electoral reform agenda. Electoral technology has been employed in different stages of the electoral cycle, including voter registration, biometric verification, voter accreditation, electronic result management and public access to election information. Cheeseman, Lynch and Willis (2020) note that technological innovations have increasingly become part of electoral reforms across Africa, although their effectiveness depends heavily on institutional capacity, political commitment, infrastructure and the broader political environment.
Nigeria’s adoption of electoral technology has occurred progressively rather than suddenly. During the tenure of Professor Attahiru Jega as Chairman of INEC, biometric voter registration and the Permanent Voter’s Card were introduced as important measures for improving voter identification and reducing electoral fraud. Jega and Hillier (2012) explain that the biometric register represented a significant improvement over previous voter registration arrangements and provided the institutional foundation for subsequent technological innovations. Subsequent INEC administrations continued this process by experimenting with electronic voting and results-management technologies during off-cycle elections.
The deployment of technology became particularly significant during the 2015, 2019 and 2023 elections. During the 2015 general elections, the Smart Card Reader was introduced to verify voters and authenticate Permanent Voter’s Cards. Although the technology encountered operational difficulties, its deployment demonstrated the growing willingness of Nigerian electoral authorities to use technology to address electoral malpractice. In subsequent elections, INEC expanded technological experimentation through electronic result-management systems.
The introduction of the Bimodal Voter Accreditation System (BVAS) and the INEC Results Viewing Portal (IReV) represented a major development in Nigeria’s electoral technology. BVAS was designed primarily to authenticate voters and prevent impersonation and multiple voting, while IReV was designed to allow the public and electoral stakeholders to view scanned copies of polling-unit result forms uploaded by election officials. The Electoral Act 2022 provided an important statutory foundation for the use of technological tools in electoral administration.
The expectation was that electronic result transmission would reduce opportunities for manipulation between the polling unit and subsequent collation levels. Traditionally, results were recorded manually at polling units and subsequently transported physically to ward, local government, state and national collation centres. Such a process created opportunities for alterations, substitutions and disputes during the movement and collation of results. Agunyai, Phago and Ebirim (2024) argue that electronic transmission was promoted as a means of reducing the opportunities for manipulation associated with manual results management.
The 2023 general elections therefore represented a major test of Nigeria’s technology-driven electoral reforms. INEC deployed BVAS across polling units and introduced IReV as a publicly accessible platform for viewing polling-unit results. INEC’s official report on the 2023 General Election indicates that the Commission uploaded polling-unit result forms to IReV and used the portal as part of its results-management process. The report further records substantial variations in the proportion of presidential results uploaded across states, including 99.23 percent in Borno State, 99.82 percent in Bauchi State and 90.15 percent in Kano State.
The deployment of IReV created an important transparency mechanism because citizens, political parties, observers and journalists could potentially compare polling-unit results with results announced at subsequent collation centres. The Election Result Analysis Dashboard (ERAD) assessment of the 2022 Ekiti and Osun governorship elections concluded that IReV improved public access to polling-unit results and could discourage the alteration of results during subsequent stages of collation. The report nevertheless emphasized the importance of strengthening technological infrastructure, cybersecurity and stakeholder engagement.
However, the experience of the 2023 general elections also exposed significant weaknesses in electronic results transmission. Although the technological architecture existed, the expected real-time visibility of results was not consistently achieved. Delays in uploading results to IReV generated widespread criticism and contributed to doubts concerning the transparency of the process. Agunyai, Ogundare and Ojakorotu (2026), in a recent study of technological innovations and the credibility of Nigeria’s 2023 presidential election, found that BVAS and IReV had important positive effects but that implementation gaps, infrastructure limitations, cybersecurity concerns and political factors limited their ability to produce the expected level of electoral credibility.
The findings of Agunyai, Ogundare and Ojakorotu (2026) are particularly important because they demonstrate that technology by itself cannot guarantee credible elections. While BVAS reduced opportunities for voter impersonation and multiple voting, technological challenges and weaknesses in the implementation of IReV affected public confidence. The authors conclude that technology must be accompanied by institutional capacity, reliable infrastructure, cybersecurity, political commitment and effective enforcement of electoral rules.
The experience also raised questions about the legal status of electronically transmitted results. The Electoral Act 2022 empowered INEC to determine the manner in which election results would be transmitted electronically. This generated debate concerning whether electronic transmission was mandatory, whether IReV uploads constituted legally binding election results and what role electronically transmitted results should play in electoral litigation. Tsokwa and Nwanegbo (2024) argue that the 2022 Electoral Act created significant expectations concerning technology but that implementation during the 2023 elections did not completely satisfy those expectations.
The legal uncertainty surrounding electronic transmission became especially important following the litigation arising from the 2023 presidential election. Questions were raised about the evidentiary value of IReV documents and whether failures or delays in electronic transmission could invalidate election results. These legal controversies demonstrated that technological reforms require corresponding legal clarity. Ogedengbe and Mohammad (2026) observe that the legal status of IReV has remained contentious and that the evolution from the Electoral Act 2022 to the Electoral Act 2026 reflects continuing disputes concerning the legal effect of electronic transmission and polling-unit results.
Consequently, electronic transmission became one of the central issues in Nigeria’s subsequent electoral reform process. Following the 2023 elections, civil society organizations, opposition political parties, electoral stakeholders and sections of the public increasingly advocated for mandatory real-time electronic transmission of polling-unit results. Their argument was that if polling-unit results were electronically transmitted immediately after counting, citizens and political parties would have a publicly verifiable record against which subsequent collation could be assessed.
The National Assembly’s 2026 electoral reform process therefore placed electronic result transmission at the centre of legislative debate. The House of Representatives initially supported provisions requiring real-time transmission of polling-unit results to IReV, whereas the Senate adopted a position that retained greater discretion for INEC concerning the manner of transmission. The divergent positions generated intense public debate because the issue was directly connected to transparency, electoral manipulation and public confidence.
The legislative controversy demonstrates that electronic transmission is not merely a technical issue. It is simultaneously a legal, political, administrative and democratic issue. The question of whether results should be transmitted electronically in real time affects the degree to which voters, political parties, election observers and the wider public can independently verify the outcome announced by electoral authorities.
The controversy intensified in February 2026 when the National Assembly debated the relevant provision governing electronic transmission. The House and Senate initially adopted different positions concerning mandatory real-time transmission. Civil society organizations and opposition actors strongly advocated compulsory electronic transmission, while proponents of the alternative position argued that the electoral commission should retain flexibility in cases involving technical or network failures.
The eventual enactment of the Electoral Act 2026 has therefore created a new legal and institutional context for examining electronic result transmission in Nigeria. President Bola Ahmed Tinubu assented to the legislation on 18 February 2026 following the National Assembly’s deliberations. Contemporary assessments of the new Act have continued to debate whether the legislation adequately protects real-time electronic transmission or retains a manual fallback that could weaken transparency.
This development is particularly important because Nigeria is preparing for the 2027 general elections. The credibility of future elections will depend partly on whether lessons from the 2023 elections are effectively incorporated into the legal and technological architecture governing elections. The debate surrounding the 2026 Electoral Act therefore provides an opportunity to assess whether Nigeria’s electoral reforms are moving toward greater transparency or reproducing some of the weaknesses associated with previous elections.
The debate also raises broader questions about the relationship between technology and electoral credibility. Technology can improve transparency by creating digital records, reducing human intervention and allowing stakeholders to access election information. However, technology can also introduce new risks involving network failure, inadequate training, cybersecurity threats, software malfunction, digital exclusion and manipulation of electronic systems. Agunyai, Ogundare and Ojakorotu (2026) emphasize that technological innovations can strengthen electoral administration but cannot independently resolve structural problems such as vote buying, political interference and weak institutional enforcement.
Similarly, Cheeseman et al. (2020) caution that technological reforms should not be treated as substitutes for broader institutional and political reforms. Electoral credibility depends upon the interaction between electoral laws, electoral management bodies, political parties, security agencies, courts, civil society and voters. When polling-unit results are uploaded and made publicly accessible, political parties and observers can independently compare digital copies with physical result sheets and identify discrepancies. This potentially strengthens accountability and discourages manipulation. However, the effectiveness of such an arrangement depends on the completeness, timeliness and authenticity of the information uploaded.
The issue of accessibility is equally important. Nigeria’s geographical size and unequal digital infrastructure create challenges for electronic transmission. Some polling units are located in areas with poor telecommunications coverage or unreliable electricity. A mandatory real-time transmission requirement must therefore be accompanied by adequate infrastructure, alternative connectivity arrangements, technical support and contingency procedures. The study seeks to examine the rationale for electronic result transmission, assess its contribution to electoral credibility, identify challenges revealed by the 2023 experience and evaluate the implications of the 2026 reform debate for Nigeria’s future elections.
1.2 Statement of the Problem
Electoral credibility remains a persistent challenge in Nigeria’s democratic development. Despite repeated electoral reforms, Nigerian elections continue to generate disputes concerning manipulation, vote buying, violence, irregularities in result management and inadequate transparency. The introduction of electoral technology was therefore expected to address some of these weaknesses and increase public confidence in electoral outcomes.
The deployment of BVAS and IReV during the 2023 general elections represented a major technological intervention. However, the experience of the election revealed a gap between the expectations created by electoral technology and its actual implementation. Although polling-unit result sheets were uploaded to IReV, delays and inconsistencies in transmission generated widespread concerns among political parties, observers and voters. Agunyai, Ogundare and Ojakorotu (2026) found that technological innovations improved some aspects of electoral administration but did not completely resolve credibility problems associated with the 2023 presidential election.
The problem was compounded by legal uncertainty. The Electoral Act 2022 provided for electronic transmission but allowed the Commission to determine the manner of transmission. Consequently, questions emerged concerning whether real-time electronic transmission was legally compulsory and whether failure to upload results immediately constituted an electoral violation. While the House supported mandatory real-time electronic transmission to IReV, the Senate retained provisions giving INEC greater discretion regarding transmission. The disagreement demonstrated the absence of consensus concerning the appropriate legal framework for electronic result management.
Although the Electoral Act 2026 was eventually enacted, controversy surrounding the electronic transmission provision has not completely disappeared. Contemporary assessments have raised concerns that provisions allowing manual transmission or fallback mechanisms could preserve vulnerabilities within the results-management process. This is significant because manual fallback arrangements may become the primary mechanism in areas experiencing technical difficulties, thereby reducing the transparency benefits associated with electronic transmission.
Another dimension of the problem is the assumption that technology automatically produces electoral credibility. Evidence from Nigeria’s 2023 elections suggests otherwise. Agunyai et al. (2026) found that while BVAS and IReV reduced some forms of electoral malpractice, they did not eliminate vote buying, institutional weaknesses, infrastructure problems or political distrust. (2026) have evaluated the technological experience of 2023. However, there remains a need to bring these technological, institutional, legal and credibility dimensions together in a systematic assessment of the 2026 reform debate.
The problem, therefore, is not simply whether Nigeria should use electronic transmission. Rather, it concerns whether the legal and institutional framework surrounding electronic transmission is sufficiently clear, enforceable, transparent and technologically reliable to enhance electoral credibility.
This study addresses this problem by examining the relationship between electronic transmission of election results and electoral credibility in Nigeria, using the 2026 electoral reform debate as its principal contemporary context.
1.3 Aim of the Study
The main aim of this study is to assess the relationship between electronic transmission of election results and electoral credibility in Nigeria, with particular emphasis on the 2026 Electoral Reform Debate.

1.6 Research Hypothesis
H₀: Electronic transmission of election results has no significant relationship with electoral credibility in Nigeria.
1.7 Significance of the Study

The study examines the evolution and application of electronic result transmission, particularly the use of the IReV platform; the experience of the 2023 general elections; technological, infrastructural and institutional challenges; legal issues surrounding electronic transmission; and the implications of the Electoral Act 2026 for future elections.
The study covers the period from the emergence of electronic result-transmission initiatives through the 2023 general elections and the subsequent 2026 electoral reform process. Particular attention is given to developments between 2025 and 2026 because of their direct relevance to the new electoral framework.
1.9 Operational Definition of Terms
Electronic Transmission of Election Results: The digital transfer of polling-unit election results from election officials to an electronic platform or central electoral database for purposes of public viewing, verification, collation or record keeping.
IReV: The Independent National Electoral Commission Results Viewing Portal established by INEC to provide public access to electronically uploaded polling-unit election result forms.
Electoral Credibility: The extent to which an election is perceived and demonstrated to be transparent, free, fair, accurate, accountable and consistent with established electoral laws and democratic standards.
