INTRODUCTION

1.1 Background to the Study

Local government is constitutionally recognized as the third tier of governance in Nigeria, established to facilitate grassroots participation in governance and promote rural development. Section 7(1) of the 1999 Constitution of the Federal Republic of Nigeria (as amended) explicitly guarantees the system of local government by democratically elected councils. The intent of this constitutional provision is to decentralize governance and empower local authorities to make decisions that directly affect their communities. Ideally, local governments are expected to plan and execute development projects, provide basic social amenities, and maintain public infrastructure. However, this constitutional ideal has not been fully realized, as local government councils across the country often operate under significant constraints imposed by state governments.

The autonomy of local governments—particularly in terms of fiscal and administrative independence—has long been a contentious issue in Nigerian federalism. Although the constitution mandates financial allocations to local councils, the creation of State Joint Local Government Accounts (SJLGA) has led to a situation where state governments exercise considerable control over local government funds. 1.3 Objectives of the Study

The primary objective of this study is to evaluate the effects of the 2024 Supreme Court judgment on local government autonomy in Oyo State.

The specific objectives are to:

1. Examine the extent to which the judgment has influenced fiscal autonomy of local governments in Oyo State.
2. Assess the impact of the judgment on administrative independence of local governments.
3. Investigate the implications of the judgment on service delivery and development planning at the local level.

1.6 Significance of the Study

1.7 Scope of the Study

The study is limited to selected local government areas in Oyo State, Nigeria. It focuses on the fiscal, administrative, and developmental implications of the 2024 Supreme Court judgment. The study spans a period from January 2024—when the judgment was delivered—to July 2025, providing a window for observing its implementation effects.

1.8 Operational Definition of Terms

Local Government Autonomy: Local government autonomy refers to the extent to which local councils are empowered to govern themselves independently, without unwarranted interference from state or federal authorities. This autonomy encompasses financial, administrative, and political dimensions. Financially, local governments should have direct access to statutory funds and the ability to generate internal revenue. Administratively, they must be able to make decisions on staffing, planning, and implementing development projects. Politically, autonomy ensures that local governments are run by elected representatives, not appointed caretaker committees. True autonomy promotes accountability, local initiative, and efficient grassroots governance. However, in practice, autonomy is often compromised by state-level dominance and inadequate legal enforcement.

Fiscal Autonomy: Fiscal autonomy is a critical component of local government independence and refers to the ability of local councils to control their financial resources. This includes both revenue generation—such as taxes, levies, and fees—and expenditure control over how funds are allocated and spent. Of particular importance is the direct access to statutory allocations from the federation account, without state government mediation. Fiscal autonomy enhances transparency and enables local governments to plan and implement development projects tailored to the needs of their communities. Lack of fiscal autonomy, such as through state-controlled joint accounts, often leads to misappropriation of funds, inefficiency, and weakened public trust in local governance.
